Terms of Use

Agreement to These Terms

Speakeroo is operated by Simple Pi Pty Ltd ("Speakeroo", "we", "us"), a company registered in New South Wales, Australia. By using speakeroo.app or the Speakeroo mobile app (together, the "Service") you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the Service.

The Service

Speakeroo lets you record yourself speaking English and returns automated feedback on pronunciation, fluency, grammar, vocabulary, and delivery. That feedback is produced by AI models, and you should treat it accordingly:

  • It is an automated estimate, not an assessment by a qualified teacher or examiner
  • It can be wrong, incomplete, or inconsistent between sessions
  • Scores are for your own practice and do not predict or guarantee the result of any exam, interview, or other assessment
  • We may change, add, or retire practice modes, models, and features at any time to improve the Service

Accounts and Eligibility

  • You must be at least 13 years old to use the Service
  • You can complete one practice session a day without an account. Keeping practicing, and every Plus feature, requires a free account
  • You are responsible for activity under your account and for keeping your sign-in email secure. Tell us at support@speakeroo.app if you think someone else has used it
  • You may only create an account for yourself, and only one account per person

Plus Subscriptions

Plus is an optional paid subscription. The list price is $4.99 USD per month or $39.99 USD per year; the App Store and Google Play show the price in your local currency, which may differ.

  • Plus renews automatically at the end of each billing period until you cancel. You are charged at the start of each period
  • On the web, Plus is billed by Stripe. Cancel any time from the Subscription page; you keep Plus until the end of the period you have already paid for
  • In the mobile app, Plus is billed by Apple or Google. Manage or cancel it in your App Store or Google Play subscription settings; we cannot cancel a store subscription for you
  • A Plus subscription is for one person and may not be shared. Plus features and limits are described on the Pricing page and may change over time
  • We do not currently offer free trials; if we introduce one, its terms will be shown before you start it

Price Changes

We may change the price of Plus. If we do, and you already subscribe:

  • We will email the address on your account at least 30 days before the new price takes effect
  • The new price applies from your first renewal after that notice period ends, never to a period you have already paid for
  • If you do not want to pay the new price, cancel before that renewal and you will not be charged it
  • Subscriptions billed by Apple or Google are also subject to the store's own price-change rules, which may require your consent before a higher price is charged

A new list price applies immediately to anyone who subscribes after it is announced.

Refunds and Consumer Guarantees

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot be excluded by agreement.

  • Beyond those rights, subscription payments are non-refundable, including for partly used periods
  • If something goes wrong with a web subscription, email support@speakeroo.app and we will look at it
  • Refunds for purchases made through the App Store or Google Play are handled by Apple or Google under their own policies, and you request them from the store

Teams

A Team is a paid plan bought by an organisation for its members. The admin who sets up a Team agrees to these Terms on the organisation's behalf and is responsible for its members' use. Members' sessions are visible to the Team as described in the Privacy Policy. Team billing, seats, and cancellation are managed by the Team admin from the Team billing page.

Your Recordings and Content

  • You own the recordings and other content you submit
  • You give us a licence to store, process, transcribe, analyse, and display that content so we can run and improve the Service, as set out in the Privacy Policy. This licence ends when you delete the content or your account, except for copies in routine backups
  • You must have the right to submit what you record or upload, including any material you did not create
  • A session created without an account can be opened by anyone who has its link. Share such links with care; we cannot revoke them

Acceptable Use

You agree not to:

  • Record or upload other people without their consent, or content you have no right to use
  • Submit unlawful, abusive, or hateful content, or use the Service to harass anyone
  • Probe, overload, scrape, or interfere with the Service, or access it by any means other than the interfaces we provide
  • Resell the Service, share one subscription between several people, or work around free plan limits
  • Reverse engineer the Service or use it to build a competing product

Intellectual Property

The Service, including its software, design, practice content, reference recordings we provide, and the Speakeroo name and logo, belongs to Simple Pi Pty Ltd or its licensors. You may use it only as these Terms allow. Third-party material we link to or embed remains the property of its owners.

Third-Party Services

The Service depends on third parties for hosting, payments, sign-in, speech recognition, and AI analysis. Payments through Apple or Google are also subject to those stores' terms. Which providers we use and what they receive is described in the Privacy Policy. We are not responsible for outages or changes at those providers, but we will work to restore the Service when they occur.

Disclaimers and Limitation of Liability

Subject to the consumer guarantees above, which we cannot exclude:

  • The Service is provided "as is" and "as available". We do not promise it will be uninterrupted, error-free, or that its feedback will be accurate
  • To the extent the law allows, our total liability to you for any claim connected with the Service is limited to the amount you paid us in the 12 months before the claim arose
  • We are not liable for indirect or consequential loss, including lost opportunities or exam outcomes, arising from your use of the Service
  • Where a consumer guarantee applies and we are permitted to limit our liability, it is limited to re-supplying the Service or paying the cost of having it re-supplied

Ending Your Use of the Service

  • You can stop using the Service at any time and delete your account from your profile. Deleting your account removes your sessions as described in the Privacy Policy
  • We may suspend or close an account that breaches these Terms, and we will tell you why unless the law prevents it
  • We may withdraw the Service or a part of it. If we withdraw Plus entirely, we will refund the unused part of any period you have paid for

Changes to These Terms

We may update these Terms. For material changes we will email account holders at least 30 days before they take effect; minor changes, such as wording or new features, are effective when posted. The "Last updated" date at the top of this page shows the current version. Continuing to use the Service after a change takes effect means you accept it.

Governing Law

These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of its courts. If you live elsewhere, this does not take away consumer protections you are entitled to under your local law.
